There are servers in restaurants who actually concern themselves with their patrons possibly driving home drunk? That’s amazing! I had no idea!
I think it’s more a concern of being implicated in a DUI legal mess.

Arizona, Colorado, Connecticut, Florida, Georgia, Idaho, Indiana, Iowa, Louisianna, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Montana, New Hampsire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oregon, Pennsylvania, Texas, Utah, Vermont, Washinton, Wisconsin and Wyoming all hold have statues or case law which provide that servers can be held liable if as guest leaves and harms someone in a drunk driving incident. I guess it doesn’t even have to be a driving incident.

Is this a new thing?
Because I’ve been in so many situations over the years (though not as much recently I admit) where I’ve seen so many people so hammered it was bleeding obvious, and nobody cut them off, or inquired as to how they were getting home.
It’s been around since at least 1994. But gaining more popularity—if that’s the right word—since then. As more people accept the notion that drunk driving is preventable, if not by the driver’s good sense, then by those who provide the alcohol.
